The Licensed Breeders Act, passed by the Texas State Legislature in 2011 and requires all dog and cat breeding organizations to be licensed, is currently facing a legal challenge on the basis that it is unenforceable and that the increased cost associated with licensing are putting breeders out of business. The law was passed to address issues of animal abuse by breeding organizations but concerns have been raised regarding the Texas Department of Licensing and Regulation’s ability to inspect facilities and effectively hold breeders accountable to the standards. The Human Society of the United States and the Texas Human Legislation Network issued a brief urging the courts to uphold the law.
