Maine

16 September 2005  Executive Order  #06 FY06/07
WHEREAS, all licensing boards, commissions and agencies have a unique ability to assist these displaced persons to return to their chosen professions and thereby move forward with their lives:
NOW, THEREFORE, I, John E. Baldacci, Governor of the State of Maine, do hereby order all licensing boards, commissions, and agencies to maximize the use of flexibility and discretion and to formulate processes as permitted under law and consistent with public safety to allow persons displaced by Hurricane Katrina to practice their professions in Maine.
The costs associated with the implementation of this Executive Order shall be absorbed by the applicable State licensing boards, commissions and agencies.

Missouri
02 September 2005 – Executive Order # 05-26 suspends licensing for Missouri Healthcare Providers treating Katrina evacuees
NOW, THEREFORE, I, MATT BLUNT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by Section 44.100, RSMo and Section 44.415, RSMo do hereby declare a state of emergency in Missouri occasioned by the impending influx of substantial numbers of hospitalized individuals from the disaster stricken regions of Louisiana, Mississippi, Florida, and Alabama to affiliated healthcare facilities in the State of Missouri. This influx of patients will compromise the ability of Missouri health care providers to care for existing patients as well as evacuees, creating a substantial risk to the safety and welfare of inhabitants of the State of Missouri. As such, I do hereby suspend the operation of any statutory requirements or administrative rules regarding the licensing, certification or issuance of permits evidencing professional skills for the healthcare providers accompanying and providing direct care to evacuees in affiliated healthcare facilities. The suspension of the appropriate statutory requirements or administrative rules regarding the licensing, certification or issuance of permits to the subject healthcare providers shall only apply with regard to their treatment of evacuees from the disaster stricken regions of Louisiana, Mississippi, Florida, and Alabama and only for treatment rendered in affiliated healthcare facilities.
This order shall terminate upon the declaration of an end to the emergency, or October 15, 2005 unless extended in whole or in part.

02 September 2005 – Executive Order # 05-27 Directs Agencies to Facilitate Temporary Licenses for Healthcare Providers Accompanying/Providing Direct Care to Evacuees
I do hereby direct all relevant state agencies to facilitate the temporary licensure, pursuant to Section 190.500, RSMo, of any healthcare providers accompanying and/or providing direct care to evacuees. Temporary licensure pursuant to Section 109.500, RSMo shall only apply with regard to the subject healthcare providers’ treatment of evacuees from the disaster stricken regions of Louisiana, Mississippi, Alabama and Florida and only in facilities in which they are approved to provide care by the appropriate licensing board or commission of the State of Missouri.
This order shall terminate upon the declaration of an end to the emergency, or October 15, 2005 unless extended in whole or in part.

South Carolina

06 September 2005  Executive Order # 2005-20
That the appropriate licensing authorities may waive all licensing and credentialing requirements under state law for the period of the federally declared public health emergency under the conditions as may be established by such authorities in consultation with the Governor’s Office, to enable out of state health care providers to render care and treatment to patients evacuated from the geographic areas identified in the federal order.

Tennessee

Executive Order #27
2. The provisions of Tenn. Code Ann. § 63-10-306, as well as any related rules, are hereby suspended to give the Commissioner of Commerce and Insurance the discretion to allow, based on an individualized determination, a pharmacist licensed in another state to engage in the practice of pharmacy in Tennessee, if such pharmacist is an evacuee from Hurricane Katrina or is a pharmacist who has come into the state to assist evacuees from Hurricane Katrina.
3. The provisions of Tenn. Code Ann. § 63-10-306, as well as any related rules, are hereby suspended to allow any person licensed to practice medicine in the State of Tennessee or authorized to practice medicine in the State pursuant to this Executive Order to dispense prescription medications without charge to evacuees from Hurricane Katrina;...

Executive Order #29
1. The provisions of Executive Order No. 27 are hereby amended to extend the suspension of all state laws and rules specified in such order until 11:59 p.m., Central Standard Time, on October 28, 2005.
2. The provisions of Executive Order No. 28 are hereby amended to extend the suspension of all state laws and rules specified in such order until 11:59 p.m., Central Standard Time, on October 28, 2005.

3. The relevant provisions of Title 63 and Title 68 of Tennessee Code Annotated, as well as any related rules, are hereby suspended to give the Commissioner of Health the discretion to allow, based on an individualized determination, a health care professional who is licensed in another state and who would otherwise be subject to licensing requirements under Title 63 or Title 68, to engage in the practice of such individual’s profession, if such individual is an evacuee from Hurricane Katrina. Such laws and rules shall be suspended only until 11:59 p.m., Central Standard Time, on October 28, 2005.

Virginia
23 September 2005:  Executive Order # 97 (as amended)
Q. A state of emergency exists for the Commonwealth in support of the proper management, care and support of persons who have been displaced by Hurricane Katrina or Hurricane Rita, evacuated from states impacted by Hurricane Katrina or Hurricane Rita, and relocated to the Commonwealth (Evacuees). These evacuees will require a variety of emergency services including, but not limited to health and medical care, social services, transportation and security services. I hereby order the following measures:

1. Designation of physicians, nurses, and other licensed and non-licensed health care providers and other individuals as well as hospitals, nursing facilities and other licensed and non-licensed health care organizations, political subdivisions and other private entities by agencies of the Commonwealth, including but not limited to the Department of Health, Department of Mental Health, Mental Retardation and Substance Abuse Services, Department of Emergency Management, Department of Transportation, Department of State Police, Department of Motor Vehicles, and Department of Social Services, as representatives of the Commonwealth engaged in emergency services activities, at sites designated by the Commonwealth, within the meaning of the immunity provisions of §44-146.23 (a) of the Code of Virginia, in the performance of their disaster-related mission assignments.

2.During the next 120 days, the Director of the Department of Health Professions shall issue temporary licenses, registrations, and certifications to practice in the Commonwealth, for a period not to exceed one year, to qualified health care practitioners who are displaced residents of Hurricane Katrina or Rita-affected states, who hold like unrestricted licenses, registrations, or certifications in their resident states, and who may be unable to furnish or have furnished on their behalf complete documentation of their credentials and license status as otherwise required by Virginia law or regulation. The Director shall also have authority to defer the payment of licensing fees. Any license, registration or certification so issued may be revoked by for cause without a hearing by the Director.
