This webinar will provide an introduction to a relatively little-known, but very powerful, litigation tool that can be used in a program’s fight against test piracy, known as an ex parte seizure order. This legal procedure, in the right circumstances, allows a testing program to conduct an unannounced raid of an alleged pirate’s premises. As a companion step to the filing of a copyright infringement lawsuit, an unannounced raid offers the opportunity to seize evidence without warning, before that evidence can be hidden or destroyed. During this webinar, attendees will learn about the legal basis for ex parte seizures, the standard for obtaining permission to conduct a seizure, and the pros and cons of this approach. This webinar is a prequel to a companion session, Lessons Learned from Pirate Raids: Case Studies Exploring the Use of Ex Parte Seizures to Combat Exam Piracy, presented at the CLEAR conference in Boston. During the conference session, several testing programs will share their own experiences and lessons learned after conducting unannounced raids upon suspected test pirates.
